Title: XL/ Delayed flight Compensation?
Post by: Jo Wissett on November 07, 2012, 03:27:23 PM
Just read on Martins money website that you may be able to claim £400+ on delayed flights.  We had no joy a few years ago when we had a 23 hour delay from XL.  Can I find any details of this flight? can I heck!! If anyone by a REMOTE chance was on the Manchester to Corfu flight around July/Aug around 2008/9 please get in touch!!!

Jo,

XL went burst in 2008...sorry I can't help with any further details.  If none of our fellow members can help perhaps it might be worthwhile posting on a Corfu wide forum/Facebook page to reach a larger audience?

We had a 10 hour delay flying home from Kos in 2004...just a year too early for compensation :-(

Well unbelievebly I have managed to find all info as had kept emails. Fingers crossed. It says up to 480 EACH!! And I had delays both ways. Bet I won't get anything though as they are not there any more. It was actually Air Malta we went with (through XL airways)

Mind you...you wouldn't want to use that site for compensation as they would take a fee...I thought the calculator might help.

Hi Jo,
We are pretty sure we were on that flight (did they put you up for the night at a hotel on the Manchester airport complex). Not sure but was it the Bewdley Hotel.

We claimed from the insurance company.
Would this claim be as well as the insurance claim.

We remember the flight well but don't have any documentation do you know
how could we find it.

Am sure that that was the flight we were delayed on ( Air Malta) What a nightmare! Stuck in a deserted terminal with no info until someone picked up a phone on a desk and demanded to know what was happening!  Cue a very grumpy man in uniform who appeared and directed everyone to a hotel for the night! Checked in the following day and faced a further  4 hour delay   ....stuck on a plane with no food or water! No joy or response after many complaints from us!

SOOOOOOOOOO we checked in as instructed again at 12 noon  for a 2pm departure. We boarded and then were left sitting on the plane until 4.30 as the luggage went missing and then the pilot couldn't get clearance to take off. We had paid for an inflight mealbut there was no hot  food on board so had to purchase extortionately priced sandwiches!
We finally arrived in Arillas at 11 pm instead of 6.30 a.m tired, hungry and angry!
That said, we returned this morning with no delays, having had a FANTASTIC fortnight at our favourite holiday spot.  For Jo's info!

Well we arrived at 9pm as instructed to check in for our midnight flight. We endured the nightmare that is Terminal 2 Manchester Airport [ every where closed apart from Alpha Retail and rather a grubby Burger King which had run out of tea, coffee and ice cream!]
So we waited and waited until 2 am with no apologies for the delay or information up on any board.
Finally a bad tempered and dismissive Duty Manager informed us that the flight had been cancelled owing to insufficient crew.
So here we all are ,back in rainy Stockport waiting to return to airport at 11:45 to check in again!
Total taxi cost to date£55!

Has anyone had any success stories re the recent flight compensation as featured on Martin's money website? I have recently heard from the ECC that my case has been accepted whatever that means but hopefully around 2k may be coming my way! (Won't hold my breath mind hah)

I assume this only relates to flight separate deals.

After trawling through old hard drives I found a back up with my old e mails and finally located the flight number(:...letter composed and ready to send..
btw flightstats works fine and gives flight info ok but you do need the original flight number.. airline..and dept date...to get the data...fingers crossed
..as there were 5 of us in the party could be a few bob on the way
.. think if distance over 1500km then up to 400 euros per passenger...
btw    flight no:
Mon 1829...25/05/2009
if anyone needs it...

Read an article saying that if flights paid for by Credit card you can now claim through the bank for delay compensation in respect of EU ruling. would obviously need all relevant info re flight docs etc but its another avenue to persue if Airline is not cooperating..

As previously posted, had a horrendous delay with Air Malta 2008/9 I think! Can anybody share any light re flight number from Manchester and dates? We were put up in a hotel for the night! Does that ring any bells? Still angry about it and keen to see justice!  In all the flight was delayed by perhaps 36 hours!

My dad has just received a letter from Monarch saying they are paying him £344 per person for their delayed flight in 2011. This was after Monarch initially turned them down and they then wrote to an adress in Athens. Guess what I'm doing tomorrow :)

Just had my claim to jet2 concerning the 6hr delay to ema on 19 sep 2011. They say i should have claimed within 2 years, so my claim would not be considered. Funny, my reconning says that 2 yrs from sep 11 is sep 13. So have written again pointing out there error and quoting the 6 ys allowed under the EC ruling. Whach this space!!

Just thought I would give you an update on my claim. As you may have read I have been trying to claim compensation for our delayed flights way back in 2008. I have been knocked back at nearly every point so as a last resort contacted both hellenic aviation authority and air malta who were the airline that were opertaing for xl that year. Today I have received an email to say that air malta will be paying us......wait for it...2000 euro's!!!!!!!!! Things like this never happen to the wissett's!!! So my advice, keep at it and don't be fobbed off! Just need the 80 million from tonights draw and I will be happy haha! Happy haha!! Keep quiet though all my facebook friends please otherwise the kids will be fleecing me haha!!

Karma.

Jen won a car in a Take a Break competition (details in earlier posts.) That would never have happened if the problems we faced hadn't happened. Now Jo has stood up to her adversity and won as well.

A large part of me believes that being part of the Arillas community, letting it all in and believing in it, will bring Karma. I now have two cases to back me up.

To anybody thinking they can't claim because they no longer have the booking ref, boarding passes and the like - as long as you know the flight number and length of delay the airline will be able to check their passenger logs to confirm you boarded the flight - nothing else is required despite what they may tell you!

Hi me again!

I just registered and had a play around with it and yes it still works!

Click on 'Flights' top left then 'Flight Status' then 'By Route

Enter departure and arrival airports then click on date to get calendar then scroll away through the years until date required and it will give you the flight numbers of all the airlines who flew that route on that day.

I went back to 2003 then gave up looking to see how far it goes back to lol!

Good luck xx

Post by: Bella on January 21, 2014, 01:11:04 AM
Hi,

If you have no paperwork you will firstly need to write to the airline and ask them to confirm from their records that you did actually board the flight giving as much detail as poss
dates, flight number, airports in and out, all names and dates of birth, addresses etc on flight.

Also say that if they cannot furnish you with the information you need that they let you know where to write to their Data Controller to gain all data they hold on you under the Data Protection Act - this in my experience usually works but if you do have to have to request under the Act - here's how to go about it

http://ico.org.uk/for_the_public/personal_information

If you hit a brick wall let me know - been to court endless times - never lost one yet

Just looked at some feedback on that Martin Lewis Forum and its looking like Thomson are just about the worst to try and get compensation off ! They appear to always use the "you need to claim within two years" line and it looks like it usually ends up going to court ! May be too much hard work , any thoughts ?

Hey!

never be or feel intimidated by a well known/large Company - you have rights and the law is on your side. Yes they will do or say all they can to not pay out - take no notice and don't be put off !

I have taken on Monarch Airlines, Easyjet, Olympic Holidays, Marks and Spencer,Tesco, B & Q, Blacks Kitchens, an unfair dismissal claim by an employer to name but a few and won every one - do your homework - know your rights and don't back down.

Pm me - more than happy to help

Hey!

Feel I should add as this bit puts most people off!

Going to Court is nothing like you expect - it's not like you see on TV!
Been maybe 6 times. It's not the Old Bailey but a small room like a GP's surgery room with you, a representative from whomever you are taking on and a Judge - nope he isn't wearing the cloaks and wig - that's for Crown Court only just a regular guy in a suite.

He says what your complaint is and what the other side has said. He asks you what is needed to resolve your complaint and then decides if it is reasonable - end  of.

Nothing to be scared of xx

Truth, if the delay happened in this country you should have no problem if you quote the ruling. Mine went back to 2008. Because it happened on the Corfu side, I wrote to the Athens address (all the different addresses are on martins money for whichever country your delay happened) and they at first tried to fob me off saying couldn't go back more than 2 years. I then quoted the law and within a week 2000 euro was in my account! I so nearly thought ah well that's that!!!

Claiming yes , but don't hold out much hope due to how long ago it was and the fact it's Thomsons, who seem the most notoriously hard to claim from !

Tempting fate for my hard earned visit home in April.... I hope everyone gets compensation for their suffering. Jen and I have been so lucky with this on our visits to Arillas. Never been delayed enough to notice.

Our only problem was landing in dangerous crosswinds in October 2012. (Sadly we didn't go in 2013 but are making up for it in a few weeks time.) I gained ten years in age landing that day and even more white hairs. Nic White had a similar experience from Manchester on the flight which "landed" before us.

Sandy and Michelle were delayed, waiting to get on the same plane out that we had come in on. We did the Prisoner Cell Block H thing through the window of Corfu Airport......

The Mythos has never tasted so good as it did when we actually arrived in one piece.

I made a. Claim to Thomas Cook for a BHX flight from last year. Their stock answer came back as technical fault  beyond their control.  Took it to CAA who recommended to TC that they paid under the Eu ruling as they did not consider the circumstances exceptional.  TC still refusing to pay so the only way forward is to pursue through small claims court which costs £80  Not sure whether to bother, but there were 5 of us and an infant so if successful could be a decent amount.

I would say persevere Vall  because we ended getting 2000 Euros for the five of us!

I am glad to say that we have had confirmation from Thomas Cook that they will pay compensation, for the 8 hour delay, on Flight TCX4119 on 7/7/14. This was the Corfu to Birmingham Flight. The amount is 800 Euros, that is 400 Euro's each. They wanted to give me vouchers, but I rang and told them in no uncertain terms that I would require the cash. They didn't quibble with that, and said the amount would go into my bank account, and it would probably take another 28 days...... Everything is 28 days with Thomas Cook.

We received our compensation last month, for our 8 hr delay last year with Thomas Cook.
It was 400 Euros each, well worth the wait.

We recently received £600 compensation (£300 each) from Thomas Cook for 5 hour flight delay to Lanzarote in 2013. Just about paid for this year's holiday to Arillas. (End of May BTW, just over 4 weeks to go)
